WHAT IS THIS CLASS ACTION ABOUT?

This class action was commenced against Lenovo (Canada) Inc. and Superfish Inc. alleging that the companies breached certain implied warranties and invaded consumers’ privacy by pre-installing a potentially malicious software called Visual Discovery designed by Superfish Inc. on several Lenovo laptops.

Settlement agreements have been reached with both Lenovo (Canada) Inc. and Superfish Inc. such that the class action is now fully resolved.

WHAT SETTLEMENTS HAVE BEEN ACHIEVED?

Settlements have been reached in this class action totalling $851,547. The settlements were approved by the Ontario Court.

Superfish Inc. and Lenovo (Canada) Inc. do not admit, and expressly deny, any wrongdoing or liability.

WHAT IS THE STATUS OF THE SETTLEMENT FUNDS?

The settlement amounts (less court-approved counsel fees, disbursements and notice costs) are being held in an interest-bearing account for the benefit of settlement class members.

WHO IS ELIGIBLE TO CLAIM?

You are eligible to make a claim if you purchased one of the following Lenovo laptops directly from Lenovo:

  • G Series: G510, G40-70, G50-70, G50-45
  • U Series: U430P, U530T
  • Y Series: Y40-70, Y50-70
  • Z Series: Z40-70, Z50-70
  • Flex Series: FLEX2-14, FLEX2-15
  • MIIX Series: MIIX2-10
  • YOGA Series: YOGA2Pro-13, YOGA2-13, YOGA2-11BTM, YOGA2-11HSW

Persons who opted out of the class action, and the defendants and certain parties related to the defendants are no eligible for payments.

HOW MUCH MONEY WILL I RECEIVE?

Payments will be distributed on a proportional basis based on the number of laptops purchased per claimant relative to the number of laptops purchased by all approved claimants. The value of your claim will depend on the total number of claimants and the total number of laptops purchased by all claimants.

Anticipated Minimum Payment

Based on class counsel’s understanding of the number of affected laptop models sold directly by Lenovo to settlement class members, class counsel anticipate that each eligible claimant will receive a minimum of $60.

Maximum Payment

Notwithstanding the foregoing, subject to further order of the Ontario Court following the adjudication of all claims, no valid claim will be assigned a value greater than $#36;250 per eligible laptop purchased.

Judicial Discretion

Further directions can be sought from the Ontario Court regarding the distribution of the settlement funds to ensure a fair and costs-effective distribution.

HOW DO I APPLY TO RECEIVE A PAYMENT?

You can apply for payments online by clicking HERE . It does not cost anything to apply to receive a payment. Lawyer fees will be paid out of the settlement funds.

WHEN IS THE DEADLINE TO FILE A CLAIM?

Claims must be submitted no later than Friday, October 30, 2020. Claims that are not made within the deadline may not be eligible for compensation.

DO I NEED PROOF OF PURCHASE?

You will most likely be able to rely on sales records provided by Lenovo (Canada) Inc. to establish your purchase. The information provided by Lenovo (Canada) Inc. will either be prepopulated within the online claim form, or will be provided only to the Claims Administrator and the Claims Administrator will have that information available to it while adjudicating your claim.

HOW DO I KNOW IF MY CLAIM WAS FILED?

Immediately after you file your claim, a page will be displayed confirming the submission of your claim.

If you do not receive this confirmation, please confirm that you have filled in all the required information. If you are unsure whether your claim was filed, email claims@trilogyclassactions.ca or call 1-866-329-7153.

WHAT HAPPENS AFTER I FILE A CLAIM?

The Ontario Court has appointed Trilogy Class Action Services as the “Claims Administrator.” The Claims Administrator will receive and review claims, make determinations in respect of entitlement to settlement benefits, and issue payments to eligible claimants.

Once all claims are received and processed, decision notices will be sent to everyone who filed claims. Decision notices will be sent to the email address you provided in the claim form. If your email address changes prior to receiving a decision notice, it is your responsibility to advise the Claims Administrator. The Claims Administrator’s decision is binding.

WHEN WILL I RECEIVE MY MONEY?

Accurate processing takes time. Depending on the number of applications filed, it could be up to one year after the claims deadline before you receive compensation. Please check this website for regular updates.

HOW WILL I RECEIVE PAYMENT?

If you are an eligible individual claimant, and you provided your email address, you will be paid by e-transfer through email. You will not be asked to provide any banking information.

If you made arrangements with the Claims Administrator, you will be paid by cheque.

WHO HAS ACCESS TO MY INFORMATION?

All information received from settlement class members or Lenovo (Canada) Inc., collected, used, and retained by the Claims Administrator for the purposes of administering the settlement agreements reached with the defendants, including evaluating your eligibility status under the settlement agreements, is protected under the Personal Information Protection and Electronic Documents Act, SC 2000 c 5. The information provided is strictly private and confidential and will not be disclosed without your express written consent, except in accordance with the settlement agreements, and/or orders of the Ontario Court.
